Strauss-Kahn in preliminary deal with maid in civil case: source

NEW YORK (Reuters) - Former International Monetary Fund chief Dominique Strauss-Kahn and the hotel maid who accused him of sexually assaulting her last year have reached a preliminary agreement to settle the civil lawsuit she brought against him, a person familiar with the case said.

The person, however, cautioned that the agreement could still fall apart.

The development was first reported by the New York Times, which cited people with knowledge of the case.

Lawyers for Strauss-Kahn and the maid, Nafissatou Diallo, will appear before a judge in New York next week, the Times reported. The newspaper said the amount of money involved in the agreement could not be determined.

The lawyers did not immediately respond to requests for comment Thursday evening.

The scandal that erupted after Diallo's allegations scuttled Strauss-Kahn's plans to run for president of his native France and forced him to resign from the IMF days after he was arrested and charged with attempted rape, among other crimes.

But the criminal prosecution fell apart after doubts emerged concerning Diallo's credibility as a witness. The Manhattan district attorney's office formally moved to dismiss the indictment in August 2011, and a judge dropped the charges.

The lawsuit, which was filed in Bronx Supreme Court in New York just weeks before the criminal charges were dropped, accused Strauss-Kahn of a "brutal" assault and sought unspecified damages. But Strauss-Kahn has maintained that the sexual encounter was consensual.

Strauss-Kahn filed his own countersuit against the maid earlier this year, claiming Diallo's accusations destroyed his career and harmed his reputation.

Diallo alleged Strauss-Kahn forced her to perform oral sex on May 14, 2011, in his luxury suite at the Sofitel Hotel in Manhattan.

Strauss-Kahn's legal troubles have persisted since his return to France, where authorities have investigated his possible involvement in a prostitution ring that included sex parties he attended in France and in Washington, D.C.

In recent months, he has attempted a political comeback on the international speaking circuit.

Strauss-Kahn and his wife, journalist Anne Sinclair, have separated.

Mystery man claims winning Powerball ticket ... in Maryland?

A man at a gas station in Maryland was caught on camera reacting with excitement to a scan of his Powerball ticket, purchased in Arizona. NBC's Tom Costello speaks to the store clerk who checked the man's numbers, and claims he's the mystery co-winner of the $580 million jackpot.

Officials say the winning tickets for the largest Powerball jackpot ever -- $587 million --?were sold in Missouri and Arizona. But on Thursday, a mystery man showed up at a gas station?in Upper Marlboro, Md., claiming to hold one of the big winners.

Surveillance video showed the man --?burly, bald, African-American and clad in a yellow construction suit -- slowly amble up to the counter, where he pulled out some lottery tickets.?

He showed them to the clerk and then repeatedly pumped his arms in excitement after reportedly seeing the numbers match.

According to Kamran Afgan, a cashier on duty at the time,?the man said something along the lines of, "Oh my God," after his numbers matched, and gave Afgan the ticket to hold and examine.

Afgan said the man told him he was from Maryland and a member of the military. It's unclear if he's based in Arizona, but his ticket was an Arizona ticket, Afgan told NBC News. Afgan?said he didn't get a chance to scan the ticket into the lottery machine because the man took it back so quickly.

The entire store was in shock, Afgan said.

Before leaving, the man showed his tickets to two other people in the store who confirmed he had the winner. At that point, the man walked out. But a moment later, he returned, saying he forget to buy gas.

One can understand how he might have been a little distracted.

No winner has come forward yet in Arizona, which means it is possible this Maryland mystery man holds a ticket worth?$293.7 million in his hands.

On Friday, Missouri lottery officials announced that a husband and wife from Dearborn, Mo., were the?lucky ticket holders in that state, and they couldn't be more shocked at their good fortune.

"I called my husband and told him, 'I think I am having a heart attack,'" Cindy Hill, 51, said, according to a Missouri Lottery press release. "I think we just won the lottery!"

She added,?"You know it's the Show Me State, so he said, 'Show me.'"

Changes in nerve cells may contribute to the development of mental illness

ScienceDaily (Nov. 28, 2012) ? Reduced production of myelin, a type of protective nerve fiber that is lost in diseases like multiple sclerosis, may also play a role in the development of mental illness, according to researchers at the Graduate School of Biomedical Sciences at Mount Sinai School of Medicine. The study is published in the journal Nature Neuroscience.

Myelin is an insulating material that wraps around the axon, the threadlike part of a nerve cell through which the cell sends impulses to other nerve cells. New myelin is produced by nerve cells called oligodendrocytes both during development and in adulthood to repair damage in the brain of people with diseases such as multiple sclerosis (MS).

A new study led by Patrizia Casaccia, MD, PhD, Professor of Neuroscience, Genetics and Genomics; and Neurology at Mount Sinai, determined that depriving mice of social contact reduced myelin production, demonstrating that the formation of new oligodendrocytes is affected by environmental changes. This research provides further support to earlier evidence of abnormal myelin in a wide range of psychiatric disorders, including autism, anxiety, schizophrenia and depression.

"We knew that a lack of social interaction early in life impacted myelination in young animals but were unsure if these changes would persist in adulthood," said Dr. Casaccia, who is also Chief of the Center of Excellence for Myelin Repair at the Friedman Brain Institute at Mount Sinai School of Medicine. "Social isolation of adult mice causes behavioral and structural changes in neurons, but this is the first study to show that it causes myelin dysfunction as well."

Dr. Casaccia's team isolated adult mice to determine whether new myelin formation was compromised. After eight weeks, they found that the isolated mice showed signs of social withdrawal. Subsequent brain tissue analyses indicated that the socially isolated mice had lower-than-normal levels of myelin-forming oligodendrocytes in the prefrontal cortex, but not in other areas of the brain. The prefrontal cortex controls complex emotional and cognitive behavior.

The researchers also found changes in chromatin, the packing material for DNA. As a result, the DNA from the new oligodendrocytes was unavailable for gene expression.

After observing the reduction in myelin production in socially-isolated mice, Dr. Casaccia's team then re-introduced these mice into a social group. After four weeks, the social withdrawal symptoms and the gene expression changes were reversed.

"Our study demonstrates that oligodendrocytes generate new myelin as a way to respond to environmental stimuli, and that myelin production is significantly reduced in social isolation," said Dr. Casaccia. "Abnormalities occur in people with psychiatric conditions characterized by social withdrawal. Other disorders characterized by myelin loss, such as MS, often are associated with depression. Our research emphasizes the importance of maintaining a socially stimulating environment in these instances."

At Mount Sinai, Dr. Casaccia's laboratory is studying oligodendrocyte formation to identify therapeutic targets for myelin repair. They are screening newly-developed pharmacological compounds in brain cells from rodents and humans for their ability to form new myelin.

Dr. Casaccia is the recipient of the Neuroscience Javits Award by the National Institute of Neurological Disorders and Stroke, a division of the National Institutes of Health, who also funded this research (R37-NS42925-10) along with the National Multiple Sclerosis Society.

Family's economic situation influences brain function in children

ScienceDaily (Nov. 28, 2012) ? Children of low socioeconomic status work harder to filter out irrelevant environmental information than those from a high-income background because of learned differences in what they pay attention to, according to new research published in the open access journal Frontiers in Human Neuroscience.

Numerous studies in the past few years have begun to reveal how poverty affects brain development and function. In 2008, Amedeo D'Angiulli of Carleton University in Ottawa, Canada and his colleagues used electroencephalography (EEG) to measure the brain wave patterns associated with an auditory selective attention task in children of high and low socioeconomic status (SES).

They found that the two groups of children exhibited differences in theta brain waves in the frontal lobe, which plays an important role in attention. This suggested that each group of children recruits different neural mechanisms for this particular type of task, and that the lower SES children allocate additional resources to attending to irrelevant information.

"Socioeconomic environment shapes the way our neurocognitive functions develop in childhood and influence the way we learn to process information when we are adults so that we can be well adapted in a certain specific type of social environment," says D'Angiulli.

For their latest study, D'Angiulli and his colleagues recruited 28 children aged 12-14 from two schools in neighborhoods of disparate socioeconomic status. One of them was attended predominantly by children from a high income background, and the other largely by children from a low income background.

The researchers performed the study at the schools during an ordinary school day. Working in a mobile lab -- a van equipped with all the apparatus needed -- they took saliva samples from the participants throughout the day, to measure changes in the levels of the stress hormone cortisol, and asked them to complete three questionnaires about their emotional and motivational state, at different times.

In the afternoon, the participants' brain waves were recorded while they performed a task in which they heard different sounds being played simultaneously into both ears, and were required to press a button as fast as possible when they heard one particular sound.

There were no significant differences between the two groups in the accuracy or reaction time during the task. The researchers did, however, observe differences in brain wave patterns between the two groups. Higher SES children exhibited far larger theta waves in response to sounds they attended to than to than those they should have ignored. In the lower SES children, however, this pattern was reversed -- the theta waves evoked by the unattended sounds were much larger than those for the attended sounds.

There were also significant differences between the two groups in the contributions of the left and right hemispheres -- lower SES children exhibited stronger theta waves in the right frontal lobe in response to attended sounds.

Overall, the lower SES children had higher cortisol levels than the higher SES children during the school day, but the differences before and after the attention task were small, suggesting that the stress response of both groups to the task was similar. And the questionnaires revealed that both groups experienced similar levels of boredom and motivation throughout the day and a similar increase of boredom before the attention task.

The findings suggest that lower SES children have to exert more cognitive control to avoid attending to irrelevant stimuli than higher SES children, and that doing so therefore requires more mental effort. This may be because they live in more threatening environments, in which it might be advantageous to pay attention to a broad range of environmental stimuli which are not unambiguous distractions, and may turn out to be important for survival.

"We are now studying how other domains that may be related to attention, such as decision-making, may differ in individuals with different socioeconomic background," says D'Angiulli.

'Fiscal cliff' talks stalled but progress possible

WASHINGTON (Reuters) - U.S. lawmakers have made little progress in the past 10 days toward a compromise to avoid the harsh tax increases and government spending cuts scheduled for January 1, a senior Democratic senator said on Sunday.

The United States is on course to slash its budget deficit nearly in half next year. Closing the gap that quickly, which in Washington is referred to as going over a "fiscal cliff," could easily trigger a recession.

"Unfortunately, for the last 10 days, with the House and Congress gone for the Thanksgiving recess ... much progress hasn't been made," Dick Durbin, the No. 2 Senate Democrat, told ABC's "This Week" program.

Serious negotiations are expected to resume this week. Democratic and Republican lawmakers have been trying to convince the public - and financial markets - that they are willing to compromise and can reach a deal before the end of the year.

Durbin indicated Democrats might accept a reform of the government's Medicare health insurance program for the elderly that would make higher-income seniors pay more for their care.

Democrats traditionally oppose limiting Medicare benefits according to income, a practice known as "means testing." Durbin said Medicaid, a public health insurance program for the poor, also could be overhauled.

But Durbin said Social Security, the federal government pension program, needs only small tweaks to ensure long-term solvency rather than major reforms.

A deadline looms over the talks. Without action by lawmakers and President Barack Obama, roughly $600 billion in tax increases and spending cuts will start to hit households and companies in early January.

'TEST OF POLITICAL COURAGE'

Republicans are averse to Democrats' plan to raise income tax rates on the wealthiest Americans, which Republicans say would hurt job creation.

Republicans also want to cut spending on social programs more than Democrats say they will accept.

House Speaker John Boehner has called for a short-term plan to avert the fiscal cliff to pave the way for Congress and the White House to agree to work during 2013 on comprehensive tax reform and longer-term spending cuts.

But Republican Senator Bob Corker said both sides need to show "political courage" and reach a bigger $4 trillion deficit reduction deal that includes both increases in revenues and cuts in spending by the end of the year.

"Kicking the can down the road ? setting up a process for token deficit reduction today with the promise of more reforms later ? is misguided and irresponsible and shows a total lack of courage," Corker wrote in an editorial in the Washington Post.

TAX REVENUES

A growing group of Republican lawmakers are loosening their ties to Grover Norquist, the anti-tax activist famous for getting elected officials to sign a pledge that they will vote against any tax increases.

Republican Senator Lindsey Graham said Republicans will allow tax revenues to rise as long as social spending programs are reformed. "I will violate the pledge - long story short - for the good of the country, only if Democrats will do entitlement reform," he told "This Week."

Graham said he supported boosting revenues by closing tax loopholes rather than by raising tax rates.

Republican Senator Saxby Chambliss said last week he "cared more about the country" than a 20-year-old pledge. On Sunday, Republican Representative Peter King, chairman of the House Homeland Security Committee, told NBC's "Meet the Press" he agreed with Chambliss.

While income tax breaks have attracted the most scrutiny, lawmakers also need to come to terms on a host of other tax incentives that are set to expire at the end of the year, including an estate tax break.

Senator Max Baucus, the chairman of the Senate Finance Committee and a key player in fiscal cliff talks, told a newspaper in his home state of Montana that he wants to preserve the estate tax break, which is important for farmers who want to pass down land worth millions of dollars to their children.

Baucus also said he hopes to preserve the production tax credit for wind energy, he told the Great Falls Tribune.

PITTSBURGH (AP) ? Rutgers officially isn't swapping the Big East for the Big Ten for another two years.

The 21st-ranked Scarlet Knights sure looked ready to check out early, though, in a lifeless 27-6 loss to Pittsburgh on Saturday.

Though Rutgers (9-2, 5-1 Big East) still managed to clinch a share of its first conference title after No. 19 Louisville was stunned at home by Connecticut, the Scarlet Knights head into a showdown with the Cardinals next Thursday reeling.

"It (stinks) to lose, but we still have something to play for," Rutgers quarterback Gary Nova said.

Even if it was the Panthers (5-6, 2-4) who performed like the team with everything on the line.

Pitt's defense swarmed the Scarlet Knights all afternoon. Nova completed just 18 of 37 passes for 157 yards with a touchdown and an interception and left briefly in first half after getting slammed to the ground on his right (throwing) shoulder.

"Their defensive linemen are really good," Nova said. "They put a lot of pressure on me, and we really didn't execute well enough in protection on their pass rush to make a difference."

The Scarlet Knights came in the Big East's biggest surprise, rising to the cusp of the school's first Bowl Championship Series berth despite losing program architect Greg Schiano to the NFL last winter.

First-year coach Kyle Flood stressed his team would not be distracted by an eventful week in which the program announced it was heading to the Big Ten in 2014, though the Scarlet Knights appeared to have their minds on other things while falling into an early 21-0 deficit.

"I didn't hear any of the talk about anything (other than the game)," Flood said. "To me, we had a focused football team coming in here, but we just didn't execute on the football field."

There were no such issues for the Panthers, who continued their maddening inconsistency while keeping their hopes for a fifth straight bowl appearance alive.

Tino Sunseri passed for 227 yards and two touchdowns in his last home game and fellow senior Ray Graham ran for 113 yards and a score as the Panthers beat a ranked opponent for the second time this season thanks to some words of inspiration from the 18 players taking their final bow at Heinz Field.

"We just told (the underclassmen) to leave it out on the field," said Graham, who moved into third on the school's all-time rushing list. "If you're not ready to play, stay inside this locker room. That's one of those attitudes that we have."

The Panthers have alternated two-game losing streaks and two-game winning streaks all fall, leading first-year coach Paul Chryst to joke he hoped the pattern would continue over the final two weeks, allowing the Panthers to play beyond Dec. 1.

It shouldn't be an issue if Pitt can take the intensity it showed during an emotional Senior Day to South Florida next week.

Chryst began the afternoon hugging each of the seniors during pregame introductions, a sign how of hard he's worked to restore a sense of trust between the players and the program after Pitt went through four coaches in a span of 14 months, culminating with Chryst's hiring in January.

The seniors believe Pitt is heading in the right direction, and then went out and showed it by having little trouble with the Scarlet Knights in the final game between the two teams for the foreseeable future with Pitt heading to the ACC next fall.

Pitt outgained Rutgers 365-207, won the field position battle and controlled both sides of the line of scrimmage after finding its footing in the second quarter.

"We put it together today," wide receiver Mike Shanahan said. "I don't think we've played 60 minutes like that all season."

Certainly not on defense.

The Scarlet Knights had the ball eight times in the first half, and punted eight times. Nova never got comfortable in the blustery conditions and Pitt smothered whichever Rutgers back happened to carry the ball.

"If you watched Pitt over the course of the year, you saw that they were capable of playing really good on offense and defense," Rutgers safety Duron Harmon said. "They beat up on Virginia Tech and should have beat Notre Dame, so we knew it wasn't going to be easy coming in here."

It wasn't.

Sunseri hit Shanahan for a 16-yard touchdown pass early in the second quarter to put the Panthers up and Graham made it 14-0 on a 1-yard touchdown plunge before the Panthers showed just how far they've come under Chryst's direction during a flawless 2-minute drill late in the half.

Taking over at the Pitt 45 with 1:19 to go, Sunseri directed the Panthers 55 yards in nine plays, the final one a perfect strike to Ed Tinker from 13 yards out that put the Panthers up 21-0 at the break.

Kevin Harper tacked on a 39-yard field goal early in the third quarter to make it 24-0. Rutgers finally got on board on a 17-yard touchdown pass from Nova to Brandon Coleman late in the third quarter but the 2-point conversion failed and Rutgers never threatened to make it interesting.

The blowout left the Scarlet Knights plenty of time to ponder how things went wrong while getting a headstart on what will be a de facto Big East championship game at home on Thursday night.

"All the marbles are out there for us, and it's a short week," defensive tackle Scott Vallone said. "So, this is for everything. This is why you play football. Sure, we're disappointed, but we still have everything to play for Thursday night. And that has to be our focus."

Shopping like a Democrat, or Republican

Black Friday: It?s a day in which most American citizens put aside politics in pursuit of shopping bargains. But in Washington we can sort almost anything in the US in terms of partisan proclivity, and temples of commerce are no exception. Want to know whether the big box store where you?re waiting in line leans Democratic or Republican? The folks at the invaluable Center for Responsive Politics have compiled a handy guide based on campaign contributions.

Toys R Us, for instance, seems a solidly blue store. Self-identified employees of the store gave $39,000 to political candidates in the 2012 election cycle, and $36,000 of that went to Democrats.

Dig into the numbers though, and you?ll see that Toys R Us is not so much Democratic as Klobucharian. All that $36,000 went to one candidate, Sen. Amy Klobuchar (D) of Minnesota. (That?s kind of odd, isn?t it? The retailer?s corporate headquarters are in New Jersey.) Other than that, Mitt Romney got $1,750 from Toys R Us workers. President Obama got zilch, according to CRP?s Open Secrets blog.

Macy?s employees, on the other hand, were big Obama fans. They donated $28,870 to the president?s reelection campaign, as opposed to $16,390 to GOP nominee Mr. Romney. This Democratic lean was counterbalanced to a certain extent by the store?s corporate political action committee, however. (Toys R Us doesn?t appear to have a central PAC.) Macy?s PAC gave $12,000 to Republicans, and $4,000 to Democrats.

Best Buy seems more of a red retailer. Both it s employees and the company?s PAC had a slight preference for Republicans, according to CRP. Store employees gave $17,662 to Democrats and $22,419 to the GOP, for instance.

But there?s Senator Klobuchar again ? she?s the individual candidate to whom Best Buy-related entities donated the most. Yes, she?s chairperson of a Senate Commerce subcommittee on competitiveness, so that might have something to do with it. Maybe the money comes due to her political affiliation with Minnesota?s Gov. Mark Dayton? Governor Dayton is the scion of the Dayton retail empire, which among other things founded Target.

Hmm, we see that Target leaned GOP as well, so maybe that theory isn?t right. Of the store?s $483,777 in individual and PAC contributions, the majority went to the right side of the aisle, according to Open Secrets. And the top recipient is not Sen. Klobuchar, but Rep. Eric Paulsen ? a Twin Cities Republican.

Then there?s Wal-Mart. Sam Walton?s empire has a major presence in politics compared with its big box brethren. Its employees and PAC gave $2.7 million to candidates in the 2012 cycle.

Employee donations skewed Republican ? which might not be surprising, since Wal-Mart is a big employer in the exurban/rural areas where Romney ran strongly. The firm?s PAC gave roughly equal amounts to candidates of both parties, however. That might be because Wal-Mart lobbies hard in Washington and needs relationships on both sides of the aisle.

In fact, Wal-Mart has spent more than $12 million on lobbyists in the past two years. It has its own Washington office, with 15 employees, and pays hundreds of thousands of dollars in retainers to such top outside lobby firms as Patton Boggs and the Podesta Group.

The firm?s No. 1 issue is sales taxes ? specifically, getting states to slap sales taxes on web retail. Rep. Steven Womack (R) of Arkansas, whose district includes Wal-Mart?s Bentonville headquarters, has long pushed national legislation that would force out-of-state online retailers to collect sales tax. He?s one of the top recipients of Wal-Mart campaign contributions.

?The traditional brick and mortar retailer is not asking for special treatment. They know they have to compete against a number of consumer criterion. What they don?t want ? and should not compete against ? is a disadvantage based on a tax loophole,? said Congressman Womack earlier this year during a Judiciary Committee hearing on the issue.

Poland's ruling party seeks charges against opposition leader

WARSAW (Reuters) - The party of Poland's Prime Minister Donald Tusk said on Thursday it would vote to have the country's main opposition leader tried at a special tribunal on charges of leading a witch hunt against rivals while his party was in power.

The move marks a new low in relations between Tusk, the leader of the Civic Platform party, and Jaroslaw Kaczynski, the head of the Law and Justice Party, who are engaged in an angry war of words.

The allegations - denied by Kaczynski - were made several years ago, but until now Tusk's party was reluctant to back a vote in parliament required to bring Kaczynski, and his former justice minister, before the tribunal.

"Our intention is mainly to protect the state against the abuse of the constitution by those in power in Poland," said Rafal Grupinski, the Civic Platform's parliamentary leader.

The abuse-of-office charges would be heard by the State Tribunal, a special political court. The tribunal could strip Kaczynski and former minister Zbigniew Ziobro of their parliamentary mandates.

Charges can be initiated in the tribunal if three-fifths of the lower house of parliament vote in support. No date has been set for a parliamentary vote. Tusk's party and two leftist-opposition parties have said they would vote for the charges, leaving them two votes short of the required threshold.

The charges stem from the suicide of leftist politician Barbara Blida in April 2007. When police arrived at her home to arrest her as part of a corruption investigation, she went into the bathroom and shot herself in the heart.

Blida's supporters said she was a victim of a politically-motivated campaign by Kaczynski's party to sideline its opponents. Kaczynski and Ziobro say the investigation into Blida was part of a legitimate effort to root out high-level graft.

Some Civic Platform leaders feared backing charges in the tribunal would exacerbate already difficult relations with Kaczynski, and could be interpreted by some as the government cracking down on dissent.

But in a sign the Civic Platform was taking a harder line against Law and Justice, Tusk accused Kaczynski on Thursday of creating an atmosphere of intolerance and hatred.

Kaczynski angered Tusk when last month he suggested the prime minister was in some way behind a plane crash in Russia in 2010 which killed Kaczynski's twin brother, Lech, and dozens of other officials.

An official investigation blamed the crash on a combination of bad weather and misjudgments by the crew and ground control.

Tusk said this sort of accusation was driving some people to take extreme actions. He has cited the example of a 45-year-old radical nationalist arrested on suspicion of plotting to blow up parliament.

"If somebody thinks of himself as a patriot and believes Kaczynski, that Poland is ruled by killers, then I'm not surprised that some react in this way," Tusk said.

"It's not like everybody can just use words that won't leave a mark in people's minds and hearts," he said.
